En faisant un appel Ă service chez Faolan vous acceptez les conditions gĂ©nĂ©rales ci dessous.GĂNĂRALITĂS1. Les conditions gĂ©nĂ©rales suivantes s'appliquent Ă toutes les commandes passĂ©es et les achats effectuĂ©s par le client (ci-aprĂšs dĂ©nommĂ© « vous ») auprĂšs de Faolan. Faolan est un illustrateur rĂ©sidant Ă Toulouse Occitanie.2. Le client passant commande ou faisant appel aux services de Faolan, quâil soit un professionnel ou un particulier, reconnaĂźt ĂȘtre majeur, non placĂ©e sous tutelle ou curatelle et avoir pris connaissance et acceptĂ© sans rĂ©serve les conditions gĂ©nĂ©rales de vente suivantes (quâil peut consulter simplement, librement et Ă tout moment en ligne ou fournies avec devis); ainsi que les mises en garde Ă©noncĂ©es dans lâExtrait de la loi n° 57-298 du 11 mars 1957 sur la propriĂ©tĂ© artistique (J.O. du 14 mars 1957) des droits des auteurs concernant les lois de la propriĂ©tĂ© intellectuelle. Veuillez vous assurer d'avoir bien lu et compris les conditions gĂ©nĂ©rales avant de passer votre commande.En cas dâachat ou de demande de service effectuĂ© sans accord parental par un mineur, nous ne serons aucunement dans lâobligation de donner un remboursement partiel ou total si le produit a Ă©tĂ© dĂ©livrĂ©.3. « Faolan» propose ses services dâillustration, de design, et trĂšs ponctuellement de la vente de produits physiques ou digitaux.4.« Faolan» se rĂ©serve le droit de modifier ses conditions gĂ©nĂ©rales de vente, ses formules et ses tarifs Ă tout moment et ce sans prĂ©avis (sauf cas Ă©chĂ©ant, si lors du dĂ©livrement d'un devis, la date n'est pas expirĂ©e ) . Ces modifications nâauront alors aucune incidence sur les commandes en cours.5. « Faolan » se rĂ©serve le droit de refuser la crĂ©ation, le dĂ©veloppement, lâintĂ©gration et la mise en ligne de tout contenu raciste, diffamant, insultant, xĂ©nophobe, homophobe, transphobe ou extrĂ©miste et, plus gĂ©nĂ©ralement, de toutes donnĂ©es allant Ă lâencontre des lois en vigueur sur le territoire Français.
II. LâENGAGEMENT ET RESPONSABILITĂ DES 2 PARTIES6. Le client et « Faolan » sâengagent Ă collaborer de maniĂšre efficace et active afin dâassurer la rĂ©alisation du contrat dans de bonnes conditions. Tout deux sâengagent Ă communiquer de maniĂšre bienveillante et efficace durant tout le processus de crĂ©ation.
III. RESPONSABILITĂ DU CLIENT7. Le Client sâengage Ă rester joignable et Ă maintenir un numĂ©ro de tĂ©lĂ©phone, une adresse e-mail et une adresse postale valides.8. Pour toute prestation (graphisme, illustration), le client sâengage Ă fournir les contenus nĂ©cessaires Ă son projet dans leur intĂ©gralitĂ© et ceci avant le dĂ©but des travaux.Si le client nâa pas transmis les contenus avant ou en mĂȘme temps que la signature du devis, il disposera de 10 (dix) jours Ă compter de lâenvoi du devis signĂ© pour transmettre les contenus nĂ©cessaires à « Tonaako » pour la crĂ©ation (signature datĂ©e du client faisant foi).
Dans le cas oĂč les contenus nâauraient pas Ă©tĂ© fournis ou seraient insuffisants une fois ce dĂ©lai de 10 jours Ă©coulĂ©, « Tonaako» proposera au client un report du projet en fonction de son planning, qui pourra intervenir dans les semaines, comme dans les mois suivants, en fonction des disponibilitĂ©s de « Tonaako ».9. Le client sâengage Ă fournir à « Faolan », sous un dĂ©lai 15 (quinze) jours aprĂšs la date de lâacceptation du devis, lâintĂ©gralitĂ© des Ă©lĂ©ments nĂ©cessaires Ă la rĂ©alisation du devis validĂ© par le client.
Si dans ce dĂ©lai le client nâa pas Ă©tĂ© en mesure de fournir les contenus, et si « Faolan » nâest pas en mesure de reporter le projet dans un dĂ©lai infĂ©rieur Ă 3 mois car son planning est complet, « Faolan » mettra fin au contrat. Lâacompte de dĂ©but de projet versĂ© par le client lors de la signature du devis et indiquĂ© dans ce dernier, ne sera pas restituĂ© et aucun remboursement ne pourra ĂȘtre rĂ©clamĂ© à « Faolan» par le client.10. Le client ou ses reprĂ©sentants sont responsables des retours et validations des Ă©tapes de la production. Ils sâengagent donc Ă ĂȘtre impliquĂ©s et rĂ©actifs afin de permettre le bon dĂ©roulement du projet. Tout dĂ©lai dâapprobation trop long entraĂźnera une rĂ©vision de la date de livraison si ladite date a Ă©tĂ© exigĂ©e par le client. «Faolan » ne sera en aucun cas tenue responsable de dĂ©lais occasionnĂ©s par les processus de supervision et dâapprobation du client.Si le client ne donne plus de nouvelles au bout dâun mois et ce aprĂšs 2 relances de la part de «Faolan», celui ci considĂšrera que le client ne souhaite plus terminer le projet. «Faolan» enverra alors une facture au client correspondant au prorata de lâavancement de la production (voir art. 19).11. En cas dâabsence de rĂ©ponse du client sur une durĂ©e de plus de 12 mois ( Ă compter du jour de prise de commande) afin dâeffectuer sa commande dâillustration, âFaolanâ se rĂ©serve le droit de ne pas effectuer de remboursement12. Dans le cadre de toute prestation dâillustration et de design, le client assume pleine et entiĂšre responsabilitĂ© des choix rĂ©alisĂ©s en matiĂšre de contenus textuels et iconographiques figurant dans la rĂ©alisation livrĂ©e par «Faolan», tout comme lâexploitation qui en sera faite, et notamment de la conformitĂ© de cette derniĂšre avec les rĂ©glementations en vigueur.Le client est civilement et pĂ©nalement responsable de la moralitĂ©, du respect des lois et rĂšglements en matiĂšre de protection des mineurs et du respect de la personne humaine et il sâengage Ă respecter les principes universels dâusage dâInternet.Le Client sâengage Ă ne pas utiliser les rĂ©alisations faites par « Tonaako » a des fins allant Ă lâencontre des lois Françaises et internationales et pouvant nuire Ă lâimage de «Tonaako».«Faolan» ne saurait aucunement ĂȘtre tenu pour responsable de lâexploitation de son travail par un client.13. Le Client assume Ă©galement ĂȘtre le propriĂ©taire des droits fournis par lui à «Faolan » dans le cadre de sa mission, et garantit «Faolan» contre toute plainte tierce relative Ă la violation des droits dâĂ©lĂ©ments et dâimages exploitĂ©es pour lâexĂ©cutions de la prestation.
IV. RESPONSABILITĂ DU PRESTATAIRE : âFaolanâ14. « Tonaako» garantit que les crĂ©ations sont juridiquement disponibles pour les utilisations prĂ©vues au titre du contrat.15. « Faolan » sâengage Ă concevoir les crĂ©ations graphiques/les illustrations conformĂ©ment au devis acceptĂ© par le client en y apportant toute la qualitĂ©, le soin et le professionnalisme nĂ©cessaires.16. « Faolan » sâengage Ă informer de maniĂšre rĂ©guliĂšre le Client de lâavancĂ©e de la rĂ©alisation du projet et ce, notamment, au travers de validations soumises au Client, et Ă respecter au mieux le dĂ©lai annoncĂ© Ă la signature du contrat.17. Dans le cadre des travaux de Graphisme/Illustration, « Faolan » sâengage Ă conserver des copies de sauvegarde des fichiers de projet du client, jusquâĂ 3 mois aprĂšs la livraison et conseille au client de faire de mĂȘme sur son propre ordinateur ou sur tout autre support quâil jugera bon dâutiliser.Dans le cas dâune destruction de lâordinateur de « Faolan » indĂ©pendante de sa volontĂ© (virus agressif, incendie, intempĂ©ries, foudre, volâŠ), sa responsabilitĂ© dans la perte des donnĂ©e sera entiĂšrement dĂ©sengagĂ©e.
V. DEVIS18. La prestation de mise en oeuvre comprend ce qui est explicitement listĂ© dans le descriptif de lâoeuvre. Si, au cours de la crĂ©ation, le client souhaite ajouter des Ă©lĂ©ments au projet (Personnages, gros objets, animaux,ou planche supplĂ©mentaire) , un nouveau devis sera ĂȘtre Ă©tabli en fonction des services supplĂ©mentaires souhaitĂ©s. Ces services interviendront alors aux mĂȘmes conditions que celles de la commande initiale.19. Le devis ou bon de commande est effectuĂ© gratuitement par «Faolan».
Les prix convenus verbalement nâengagent «Tonaako» que si ils sont Ă©tĂ© validĂ©s par un devis Ă©crit ou par mail.20. Les tarifs sont affichĂ©s HT. et sâentendent en euros. Les conversions de tarifs affichĂ©s en dollars amĂ©ricains (USD) peuvent varier selon la valeur du cours de la monnaie europĂ©enne (Euro / âŹ).La TVA est non applicable chez << Tonaako>> pour lâannĂ©e 2024-2025 selon lâarticle 293B des conditions gĂ©nĂ©rales des ImpĂŽts.21. Pour toutes les prestations de Print, dâIllustration et de design, le total de la facture est dĂ» Ă la commande, accompagnĂ© des devis et CGV signĂ©s par le client avec la mention âbon pour accordâ et ce avant le dĂ©but de toute prestation. Si le client rencontre des difficultĂ©s Ă payer cette somme en une fois, âFaolanâ sâengage Ă discuter dâun acompte qui diviserait la facture en 2 versement ou de facilitĂ©s de paiement et ceci Ă lâĂ©tape du devis seulement.22. « Faolan » se rĂ©serve le droit de refuser un contrat avec un client si une commande prĂ©cĂ©dente a dĂ©jĂ donnĂ© lieu Ă un litige de paiement.23. Une fois validĂ© par le Client, le devis a valeur de contrat et engage les deux parties.
VI. RĂALISATION DES TRAVAUX24. Lors de la crĂ©ation de fichiers destinĂ©s Ă lâimpression ou contenant du texte, le client est tenu de fournir à « Tonaako » des contenus textes tapĂ©s au kilomĂštre et rapidement exploitables dans le processus de crĂ©ation digitale.
Tout contenu texte Ă©crit manuellement et scannĂ© ou photographiĂ©, ne sera pas prise en compte. Si le client nâa pas les moyen de fournir à « Tonaako » un document tapĂ© au kilomĂštre, la charge de travail supplĂ©mentaire consistant Ă saisir le texte en question et Ă en vĂ©rifier lâorthgraphe, donnera lieu Ă un supplĂ©ment de facturation.25. Lors de la crĂ©ation de fichiers destinĂ©s Ă lâimpression, le client est tenu de vĂ©rifier les textes, orthographes et tout autre Ă©lĂ©ment constituant la mise en page au prĂ©alable afin dâĂ©viter dâĂ©ventuelles corrections supplĂ©mentaires. AprĂšs la validation finale du fichier par le client, « Tonaako » ne saurait ĂȘtre tenue responsable des Ă©ventuelles erreurs de texte, dâorthographe ou de tout autre Ă©lĂ©ment constituant une mise en page.26. La prestation de « Tonaako » comprend la liste prĂ©cise des travaux et Ă©lĂ©ments mentionnĂ©s dans le devis et approuvĂ© par le client au dĂ©but du contrat, toute modification ultĂ©rieure ou ajout apportĂ© au devis de dĂ©part devra ĂȘtre approuvĂ©e par « Tonaako » et fera lâobjet dâune nouvelle facturation.
Ces modifications pourront donner lieu Ă un dĂ©lais de livraison supplĂ©mentaire.27. Les dĂ©lais ou dates de livraison, quâils soient fermes ou non, doivent ĂȘtres stipulĂ©s par Ă©crit dĂšs la rĂ©alisation du devis. Dans le cas contraire «Tonaako» ne saurait ĂȘtre responsable dâun dĂ©lai imposĂ© par le Client et non acceptĂ© par eux .Dans le cas dâun retard occasionnĂ© par des modifications de la part du Client ou des problĂšmes liĂ©s Ă des produits tiers (logiciels, informatiqueâŠ) le dĂ©lai ou la date de livraison se verront repoussĂ©s en consĂ©quence. «Tonaako» ne peut ĂȘtre tenu responsable du non-respect des dĂ©lais dans tous les cas de force majeure, tels que pannes informatiques et autres Ă©lĂ©ments qui ne sont pas directement de son fait.

By making a call for service at Faolan you accept the general conditions below.GENERALITIES1. The following terms and conditions apply to all orders placed and purchases made by the customer (hereinafter referred to as "you") from Faolan. Faolan is an illustrator living in Toulouse Occitanie.2. The customer placing an order or using the services of Faolan, whether a professional or an individual, acknowledges being of legal age, not under guardianship or curatorship and having read and accepted without reservation the following general conditions of sale (which he can consult simply, freely and at any time online or provided with a quote); as well as the warnings set out in the Extract of Law No. 57-298 of March 11, 1957 on artistic property (OJ. of March 14, 1957) of the rights of the authors concerning intellectual property laws. Please make sure you have read and understood the terms and conditions before placing your order.In the event of a purchase or service request made without parental consent by a minor, we will not be obliged to give a partial or full refund if the product has been issued.3. "Faolan" offers its services of illustration, design, and very occasionally the sale of physical or digital products.4.« Faolan" reserves the right to modify its general conditions of sale, formulas and rates at any time and without notice (except if applicable, when a quote is issued, the date has not expired). These changes will then have no impact on current orders.5. "Faolan" reserves the right to refuse the creation, development, integration and posting of any racist, defamatory, insulting, xenophobic, homophobic, transphobic or extremist content and, more generally, any data that goes against the laws in force on French territory.
II. THE COMMITMENT AND RESPONSIBILITY OF THE 2 PARTIES6. The customer and "Faolan" undertake to collaborate effectively and actively in order to ensure the completion of the contract in good conditions. Both are committed to communicating in a benevolent and effective manner throughout the creative process.
III. CUSTOMER RESPONSIBILITY7. The Customer undertakes to remain reachable and to maintain a valid telephone number, e-mail address and postal address.8. For any service (graphics, illustration), the client undertakes to provide the content necessary for his project in their entirety and this before the start of the work.If the customer has not transmitted the contents before or at the same time as the signing of the quote, he will have 10 (ten) days from the sending of the signed quote to transmit the necessary content to "Tonaako" for the creation (dated signature of the customer as authentic).In the event that the contents have not been provided or are insufficient once this 10-day period has elapsed, "Tonaako" will offer the customer a postponement of the project according to his schedule, which may take place in the weeks, as well as in the following months, depending on the availability of "Tonaako".9. The customer undertakes to provide "Faolan", within 15 (fifteen) days after the date of acceptance of the estimate, with all the elements necessary for the realization of the estimate validated by the customer.If within this period the customer has not been able to provide the content, and if "Faolan" is not able to postpone the project within less than 3 months because its schedule is complete, "Faolan" will terminate the contract. The deposit at the beginning of the project paid by the customer when signing the estimate and indicated in it, will not be returned and no refund can be claimed from "Faolan" by the customer.10. The customer or his representatives are responsible for the returns and validations of the stages of production. They therefore undertake to be involved and reactive in order to allow the smooth running of the project. Any approval time that is too long will result in a review of the delivery date if that date has been requested by the customer. "Faolan" will in no way be held responsible for delays caused by the customer's supervision and approval processes.If the customer no longer gives news after a month and after 2 reminders from "Faolan", he will consider that the customer no longer wishes to complete the project. "Faolan" will then send an invoice to the customer corresponding to the pro rata of the progress of the production (see art. 19)11. In the absence of a response from the customer over a period of more than 12 months (from the day of placing the order) in order to place his illustration order, "Faolan" reserves the right not to make a refund12. In the context of any illustration and design service, the customer assumes full responsibility for the choices made in terms of textual and iconographic content contained in the production delivered by "Faolan", as well as the exploitation that will be made of it, and in particular the compliance of the latter with the regulations in force.The client is civilly and criminally responsible for morality, compliance with laws and regulations on the protection of minors and respect for the human person and he undertakes to respect the universal principles of Internet use.The Customer undertakes not to use the achievements made by "Tonaako" for purposes that go against French and international laws and may harm the image of "Tonaako"."Faolan" cannot be held responsible for the exploitation of its work by a client.13. The Customer also assumes to be the owner of the rights provided by him to "Faolan" as part of his mission, and guarantees "Faolan" against any third-party complaint relating to the violation of the rights of elements and images exploited for the execution of the service.
IV. RESPONSIBILITY OF THE PROVIDER: "Faolan"14. "Tonaako" guarantees that the creations are legally available for the uses provided for under the contract.15. "Faolan" is committed to designing graphic creations/illustrations in accordance with the estimate accepted by the client, providing all the necessary quality, care and professionalism.16. "Faolan" undertakes to regularly inform the Customer of the progress of the implementation of the project, in particular through validations submitted to the Customer, and to respect as best as possible the deadline announced at the signing of the contract.17. As part of the Graphic Design/Illustration work, "Faolan" undertakes to keep backup copies of the customer's project files, up to 3 months after delivery and advises the customer to do the same on his own computer or on any other medium that he deems appropriate to use.In the event of a destruction of the "Faolan" computer independent of his control (aggressive virus, fire, bad weather, lightning, theft...), his responsibility for the loss of data will be completely disengaged.

V. QUOTE18. The implementation service includes what is explicitly listed in the description of the work. If, during the creation, the customer wishes to add elements to the project (Characters, large objects, animals, or additional board), a new quote will be drawn up based on the additional services desired. These services will then take place under the same conditions as those of the initial order.19. The quote or purchase order is made free of charge by "Faolan".Verbally agreed prices only commit "Tonaako" if they have been validated by a written quote or by email.20. The rates are displayed excluding VAT and are in euros. Conversions of rates displayed in US dollars (USD) may vary according to the value of the European currency (Euro / âŹ).VAT is not applicable at << Tonaako>> for the year 2024-2025 according to Article 293B of the General Tax Conditions.21. For all Print, Illustration and design services, the total invoice is due to the order, accompanied by the estimates and GTC signed by the customer with the words "good for agreement" before the start of any service. If the customer encounters difficulties in paying this amount in one go, "Faolan" undertakes to discuss a deposit that would divide the invoice into 2 payments or payment facilities and this at the quote stage only.22. "Faolan" reserves the right to refuse a contract with a customer if a previous order has already given rise to a payment dispute.23. Once validated by the Customer, the quote has the value of a contract and commits both parties.
VI. COMPLETING THE WORK24. When creating files intended for printing or containing text, the customer is required to provide "Tonaako" with text content typed by the kilometer and quickly usable in the digital creation process.Any text content written manually and scanned or photographed will not be taken into account. If the customer does not have the means to provide "Tonaako" with a document typed by the kilometer, the additional workload of entering the text in question and checking its spelling will result in an additional billing.25. When creating files for printing, the customer is required to check the texts, spellings and any other element constituting the layout beforehand in order to avoid possible additional corrections. After the final validation of the file by the customer, "Tonaako" cannot be held responsible for any errors in text, spelling or any other element constituting a layout.26. The service of "Tonaako" includes the precise list of work and elements mentioned in the quote and approved by the customer at the beginning of the contract, any subsequent modification or addition to the initial estimate must be approved by "Tonaako" and will be subject to a new invoicing.These changes may result in additional delivery times.27. Delivery times or dates, whether firm or not, must be stipulated in writing as soon as the estimate is made. Otherwise, "Tonaako" cannot be held responsible for a period imposed by the Customer and not accepted by them.In the event of a delay caused by changes on the part of the Customer or problems related to third-party products (software, computers...) the delivery deadline or date will be postponed accordingly. "Tonaako" cannot be held responsible for non-compliance with deadlines in all cases of force majeure, such as computer failures and other elements that are not directly caused by it.
